Regular Meeting

November 2, 2010

 

The Mayor and Council of the City of Fairbury met in regular session in the Council Chambers located at 612 D Street, Fairbury, Nebraska, on the 2nd day of November 2010, at 7:30 p.m.   Mayor Homer L. Ward called the meeting to order.

 

Notice of meeting was given in advance thereof by publication in the Fairbury Journal News, Fairbury, Nebraska, the designated method of giving notice, as shown by affidavit of publication.  The Open Meetings Act was posted in the meeting room and pointed out by Mayor Ward as required by law.

 

Roll call found the following Council Members present: Doug Brown, Ed Friesen, Roger Bailey, Tim Polson, Phil Rogge, Shirley Bender, Brad Kuzelka, and Kelly Davis.  

 

Mayor Ward called for the submittal of forms to request future agenda items.  No forms were submitted during the meeting. 

 

Mayor Ward read the Consent Agenda: 

1.      Approval of the minutes of the regular meeting of October 19, 2010.

2.      Approval of claims.

 

Rogge moved to approve the Consent Agenda.  Motion seconded by Bender.  On roll call, Polson, Bailey, Friesen, Brown, Rogge, Bender, Kuzelka, and Davis voted “yes.”  Motion carried. 

 

Friesen moved to approve the appointments of Cory DeFrain as full time police officer and Torrick Friels as part time police officer.  Motion seconded by Bailey.  Council member Brad Kuzelka asked Police Chief Chad Sprunk which certifications Friels was missing.  Sprunk stated at the time of Friels application, he did not have a Nebraska Drivers License and he is currently certified in Louisiana; he will have to go through reciprocity to get certified in Nebraska.  Reciprocity testing and training is over a two week period, which will start the first of the year, at the Nebraska Law Enforcement Training Center.  Sprunk stated Friels will start immediately with his extensive training with the city’s police department.   On roll call, Polson, Bailey, Friesen, Brown, Rogge, Bender, Kuzelka, and Davis voted “yes.”  Motion carried.  DeFrain was sworn into office by City Attorney David Bargen, who administered the Oath of Office to DeFrain.  Friels was sworn into office by City Attorney David Bargen, who administered the Oath of Office to Friels.

 

Fire Chief Eric Voss gave a demonstration of the new air packs the fire department received through a FEMA grant.  The fire department received a total of fifteen air packs.  The air packs are 4500 PSI bottles and will hold the air for forty-five minutes which will give the firefighters longer time to be inside the structure to fight the fires.  The bottles also glow in the dark which will make it easier for the firefighters to follow each other when fighting a fire.  They also received six amplifiers, which they can pass back and forth between the firefighters, which will improve the communication between the firefighters that are inside the burning structure and with the Fire Chief being outside the burning structure.  The amplifiers will also help the firefighters hear each other talk and also when they’re talking on the radio.  Voss stated all the firefighters have been trained with the air packs; each firefighter has their own mask and have been fit-tested for the masks.

 

Rogge moved to adopt Resolution No. 798 authorizing the Mayor to enter the City of Fairbury into an interlocal agreement for the administration of the Rural Apprehension Program.  Motion seconded by Bender.  Council member Shirley Bender asked if the amount the City of Fairbury has to pay which is based per capita on the 2000 census if this is something we could talk to them about since we’re doing a new census.  Citizen Rick Carmichael stated this has not changed since the grant is coming from the feds it has stayed the same – it has only dropped a small amount of money and they’re trying to keep the per capita the same.  On roll call, Polson, Bailey, Brown, Friesen, Rogge, Bender, Kuzelka, and Davis voted “yes.”  Motion carried. 

 

Mayor Ward read by title Ordinance No. 2999:  AN ORDINANCE AMENDING ORDINANCE NO. 2998 REGARDING THE DEFINITIONS, SALE, IGNITION, AND REGULATION OF FIREWORKS.  Bailey moved to suspend the statutory three readings requirement for Ordinance No. 2999.  Motion seconded by Rogge.  On roll call, Polson, Bailey, Friesen, Brown, Rogge, Bender, Kuzelka, and Davis voted “yes.”  Motion carried.  Brown moved for the final passage of Ordinance No. 2999.  Motion seconded by Kuzelka.  On roll call, Polson, Bailey, Friesen, Brown, Rogge, Bender, Kuzelka, and Davis voted “yes.”  Motion carried. 

 

Within the Mayor’s report, Mayor Ward stated he has had a difficult time getting people to serve on committees.  Mayor Ward stated he has had discussion with different committees and they would like a council member to be the liaison so they would have an idea of what is going on with the different committees.  Mayor Ward wants the Council to consider this.

 

Polson moved to adjourn the meeting.  Motion seconded by Rogge.  On roll call, Polson, Bailey, Friesen, Brown, Rogge, Bender, Kuzelka, and Davis voted “yes.”  Motion carried.  Meeting adjourned at 7:46 p.m.
