CITY COUNCIL AGENDA

All agenda items are for discussion and action will be taken as deemed appropriate.  The City Council reserves the right to go into executive session in accordance with Section 84-1410.

 

A.     CALL TO ORDER

1.       Pursuant to Section 84-1412(8) of the Nebraska Open Meetings Act a current copy of the Open Meetings Act is posted in the entry of this meeting room and is available for viewing by the public.

C.     CONSENT AGENDA

1.       Approval of the minutes of the regular meeting of August 21, 2007.

2.       Approval of claims.

 

D.     PUBLIC HEARINGS

1.      Set public hearing concerning a request for LB840 funds from Lambriar Animal Health Care.

2.      Set public hearing concerning the setting of the final tax request for the 2007-2008 Fiscal Year for the General Fund and for the Bond Fund.

3.       Set date of Budget Hearing and Budget Summary for the 2007-2008 Fiscal Year.

 

E.      CURRENT BUSINESS

1.       Consideration of a letter received from Timothy Noerrlinger resigning from his position as City Attorney.

2.       Consideration of a letter received from Linda Bauer resigning from her position as Deputy City Attorney.

3.       Approval of the appointment of Tobias J. Tempelmeyer as Interim City Attorney.

4.       Consideration of a Legal Services Agreement between the City of Fairbury and Tobias J. Tempelmeyer.

5.       Consideration of Report of Independent Legal Counsel, Jerry Pigsley of Harding & Shultz, retained to review Recall Procedure and Special Election Process Concerning Mayor Mueller.

6.       Scheduling date of Special Recall Election of Mayor Mueller.

7.       Review of a request from Lambriar Animal Health Care for a grant of LB840 funds.

8.       Consideration of a request from the United Methodist Church for permission to reserve the east and south sides of the church for parking during its annual Bazaar on September 8, 2007 from 8:00 a.m. - 1:00 p.m.

9.       Consideration of a request to allow Steve Zimmerman to transfer to the City Volunteer Fire Department from the Rural Volunteer Fire Department.

10.   Update on complaint received regarding wolf hybrid dogs.

11.   Consideration of a request from the United Methodist Church for a curb cut at the parsonage located at 2107 Northridge Drive.

12.   Consideration of a request from Phil Rogge for a curb cut at 1324 12th Street.

 

F.      RESOLUTIONS AND ORDINANCES

1.       Third Reading  Ordinance No. 2962:  AN ORDINANCE TO ESTABLISH RATES, FEES, CHARGES, AND COLLECTIONS FOR THE USE OF ELECTRICITY TO AMEND ORDINANCE NO. 2931; TO REPEAL CONFLICTING SECTIONS AND TO PROVIDE FOR AN EFFECTIVE DATE.

2.       Second Reading  Ordinance No. 2963:  AN ORDINANCE SETTING SALARIES FOR SUPERVISORS AND DEPARTMENT HEADS; PROVIDING FOR THE EFFECTIVE DATE THEREOF; AND REPEALING CONFLICTING ORDINANCES.

3.       Second Reading  Ordinance No. 2964:  AN ORDINANCE SETTING SALARIES FOR CITY EMPLOYEES COVERED BY IBEW AGREEMENT; PROVIDING FOR THE EFFECTIVE DATE THEREOF; AND REPEALING CONFLICTING ORDINANCES.

4.       Second Reading  Ordinance No. 2965:  AN ORDINANCE OF THE CITY OF FAIRBURY, NEBRASKA ADOPTING THE NEBRASKA EMERGENCY SUCCESSION ACT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A TIME WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT AND REPEALING ALL ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH.
