CITY COUNCIL AGENDA

1.       Pursuant to Section 84-1412(8) of the Nebraska Open Meetings Act a current copy of the Open Meetings Act is posted in the entry of this meeting room and is available for viewing by the public.

1.       Approval of the minutes of the regular meeting of July 17, 2007.

D.     PUBLIC HEARINGS

1.      Set public hearing concerning the semi-annual review of the Local Option Sales Tax (LB840) Program.

2.      Set public hearing concerning an Application for a Special Use Permit (SUA-2007-003) submitted by Chris & Mindy Frazier for permit to operate a home occupation (buying, breeding, & selling of dogs) in the R2 – Medium Density Residential zoning district (1402 5^th Street).

3.       Public hearing concerning an Application for a Special Use Permit (SUA-2007-002) submitted by Rolland Moellenberndt for a permit to operate a home occupation (taxidermy shop) in the TA – Transitional Agriculture zoning district (at 56905 Highway 136).

4.       Public hearing concerning Replat/Small Tract Subdivision request (RST-2007-001) from Bernard C. Boerner Trust for allowance to subdivide property described as follows:  all of Lots 7 & 8 except the South 5 feet thereof, Block 11, Original Town of Fairbury.

E.      CURRENT BUSINESS

1.       Consideration of the Airport Authority’s Tax Request for Fiscal Year 2007-2008.

2.       Consideration of a Certification of Confidentiality.

3.       Consideration of adopting updated Procurement Procedures and Code of Conduct.

4.       Consideration of City Administrator Contract.

5.       Consideration of a request from JCEDC to use the west side of the square on Saturday mornings from 9:00 a.m. to 11:00 a.m. for a Farmers Market.

6.       Consideration of an Application for a Special Designated License for the Side Trek Bar & Grill to have a beer garden & dance during Fairbury Fest.

7.       Consideration of a request from TrailBlazers to block E Street between 3^rd & 4^th Streets and all parking stalls around the square for a bike and car show on September 9, 2007.

F.      RESOLUTIONS AND ORDINANCES

1.       Resolution No. 663 providing for the creation of a standing committee on housing and repealing any resolutions in conflict herewith.

2.       Third Reading    Ordinance No. 2960:  AN ORDINANCE OF THE CITY OF FAIRBURY, NEBRASKA, ESTABLISHING A MULTI-DOG HOUSEHOLD PERMIT; A KENNEL PERMIT; A PROCEDURE TO OBTAIN SAID PERMITS; REGULATIONS FOR SAID PERMITS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR A TIME WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.

3.       Second Reading   Ordinance No. 2961:  AN ORDINANCE ESTABLISHING MINIMUM MUNICIPAL CHANGE OF OCCUPANCY HOUSING STANDARDS; ESTABLISHING PROVISIONS FOR COMPLIANCE THEREWITH; PROVIDING FOR PUBLICATION IN PAMPHLET FORM AND FOR AN EFFECTIVE DATE.

4.       Ordinance No. 2962:  AN ORDINANCE TO ESTABLISH RATES, FEES, CHARGES, AND COLLECTIONS FOR THE USE OF ELECTRICITY TO AMEND ORDINANCE NO. 2931; TO REPEAL CONFLICTING SECTIONS AND TO PROVIDE FOR AN EFFECTIVE DATE.
