CITY OF FAIRBURY, NEBRASKA

COUNCIL AGENDA              

 

TUESDAY, DECEMBER 7, 2010, 7:30 p.m.

 

All agenda items are for discussion and action will be taken as deemed appropriate.  The City Council reserves the right to go into executive session in accordance with Section 84-1410.

 


 

A.     CALL TO ORDER

1.      Pursuant to Section 84-1412(8) of the Nebraska Open Meetings Act a current copy of the Open Meetings Act is posted in the entry of this meeting room and is available for viewing by the public.

2.      Administer oath of office to the newly elected officials for the City of Fairbury

a.      Timothy Polson – Councilperson Ward I

b.      Bradley Kuzelka – Councilperson Ward II

c.      Rick L. Carmichael – Councilperson Ward III

d.      Joshua Vossler – Councilperson Ward IV

3.      Roll Call

4.      Nomination of President of the Fairbury City Council.   

5.      Approval of the following appointments:                                

·        City Attorney

·        Deputy City Attorney

·        City Administrator

·        City Clerk/Treasurer

·        Street & Sanitation Superintendent/Parks & Recreational

Director

·        Fire Chief

·        Superintendent of Utilities

·        Building Inspector

·        Plumbing Inspector

·        State of Nebraska as the Electrical Inspector

·        City Physician

6.      Administer oath of office to the appointments of the City Attorney/Deputy City Attorney.

7.      Administer oath of office to the appointments made by the Mayor.

 

B.    SUBMITTAL OF REQUESTS FOR FUTURE ITEMS

Individuals who have appropriate items for City Council consideration should complete the Request for Future Agenda Items form located near the entrance of the meeting room.  If the issue can be handled administratively without Council action, notification will be provided.  If the item is scheduled for a committee or Council meeting, notification of the date will be given.

 

C.    CONSENT AGENDA

1.      Approval of the minutes of the regular meeting of November 16, 2010.

2.      Approval of claims.

3.      Approval of the appointment of Jill Brueggemann to the Museum Board. 

  Term to expire July 2014.

 

D.    PUBLIC HEARINGS 

1.      Public Hearing regarding request for changes to Section 5.18 – HD of the Fairbury Zoning Regulations – 2005 Edition (Historic District – Overlay).

 

E.      CURRENT BUSINESS

1.      Consider WasteWater Treatment Plant Blower Replacement/Rod Kirkland, Olsson Associates.

2.      Consider request from Patricia Welke regarding pet incident.

3.      Consider request from the Fairbury Public Library Board of Trustees for additional funding from the City of Fairbury for repair of the roof and gutters of the 1988 addition to the Fairbury Public Library.

4.      Consider Right-of-Way Construction/Use Permit Application for the First Baptist Church located at 902 F Street for a curb cut.

 

F.     RESOLUTIONS AND ORDINANCES

1.      Resolution No. 799 obligating LB840 funds to Livingston Enterprises, Inc. - Bruce Livingston at 500 4th Street for a “Downtown Design Challenge Grant” in the amount of $3,000.00.

2.      Resolution No. 800 obligating LB840 funds to Livingston Enterprises, Inc. - Bruce Livingston at 500 ½ 4th Street for a “Downtown Design Challenge Grant” in the amount of $3,000.00.

3.      Resolution No. 801 obligating LB840 funds to Livingston Enterprises, Inc. - Bruce Livingston at 502 4th Street for a “Downtown Design Challenge Grant” in the amount of $3,000.00.

4.      Resolution No. 802 obligating LB840 funds to Oregon Trail Development, LLC - Geri Katz for a “Downtown Design Challenge Grant” in the amount of $3,000.00.

5.      Ordinance No. 3000: AN ORDINANCE AMENDING FAIRBURY ZONING REGULATIONS – 2005 EDITION, SECTION 5.18 TO UPDATE THE CITY’S HISTORIC OVERLAY DISTRICT AND TO COMPLY WITH PARTICULAR FEDERAL AND STATE GOVERNMENT CERTIFICATIONS REGARDING HISTORIC PRESERVATION.
