CITY OF FAIRBURY, NEBRASKA

COUNCIL AGENDA              

 

TUESDAY, JANUARY 4, 2011, 7:30 p.m.

 

All agenda items are for discussion and action will be taken as deemed appropriate.  The City Council reserves the right to go into executive session in accordance with Section 84-1410.

 


 

A.     CALL TO ORDER

1.      Pursuant to Section 84-1412(8) of the Nebraska Open Meetings Act a current copy of the Open Meetings Act is posted in the entry of this meeting room and is available for viewing by the public.

2.      Roll Call

 

B.    SUBMITTAL OF REQUESTS FOR FUTURE ITEMS

Individuals who have appropriate items for City Council consideration should complete the Request for Future Agenda Items form located near the entrance of the meeting room.  If the issue can be handled administratively without Council action, notification will be provided.  If the item is scheduled for a committee or Council meeting, notification of the date will be given.

 

C.    CONSENT AGENDA

1.      Approval of the minutes of the regular meeting of December 21, 2010.

2.      Approval of claims.

3.      Approval of the resignation of John L. Davis as Police Officer/K9 Handler for the City of Fairbury; effective January 15, 2011.

 

D.    PUBLIC HEARINGS 

1.      Public Hearing regarding the addition of Hotel/Motel as a permitted use in Section

5.10 B1 – General Commercial Zoning District of the Fairbury Zoning Regulations – 2005 Edition.

 

E.      CURRENT BUSINESS

1.      Consider recommendation from the Public Safety Committee regarding advertising for a full time police officer.

2.      Consider recommendation from the Public Safety Committee regarding continuation of City K-9 Program.

 

F.     RESOLUTIONS AND ORDINANCES

1.      Resolution No. 803 to approve transfer of administrative responsibilities for Intoxilyzer Fund from the City of Fairbury to Jefferson County.

2.      Resolution  No. 804 levying and assessing various fees, bonds or deposits, including but not limited to sanitary sewer and water connection fees, and repealing Resolution 772.

 

3.      Third Reading:  Ordinance No. 3000: AN ORDINANCE AMENDING FAIRBURY ZONING REGULATIONS – 2005 EDITION, SECTION 5.18 TO UPDATE THE CITY’S HISTORIC OVERLAY DISTRICT AND TO COMPLY WITH PARTICULAR FEDERAL AND STATE GOVERNMENT CERTIFICATIONS REGARDING HISTORIC PRESERVATION.

4.      Second Reading: Ordinance No. 3001:  AN ORDINANCE AMENDING FAIRBURY MUNICIPAL CODE §§ 94.28, 94.29, AND 94.30 REGARDING DANGEROUS DOGS TO HARMONIZE SECTIONS WITH STATE STATUTE AND TO INCLUDE A HEARING PROCESS.

5.  Second Reading: Ordinance No. 3002:  AN ORDINANCE AMENDING FAIRBURY MUNICIPAL CODE § 93.105 TO PLACE AUTHORITY FOR AUTHORIZATION OF CURB CUTS IN THE OFFICE OF THE STREET SUPERINTENDENT.

6.      Second Reading: Ordinance. No. 3003:  AN ORDINANCE AMENDING FAIRBURY   MUNICIPAL CODE § 33.16 REGARDING ORGANIZATIONAL MEETINGS OF THE MAYOR AND CITY COUNCIL.

7.      Ordinance No. 3004:  AN ORDINANCE AMENDING FAIRBURY ZONING REGULATIONS  - 2005 EDITION, § 5.10 TO ALLOW HOTELS AND MOTELS IN THE GENERAL COMMERCIAL DISTRICT.
