CITY OF FAIRBURY, NEBRASKA

COUNCIL AGENDA              

 

TUESDAY, February 7, 2012, 7:30 p.m.

 

All agenda items are for discussion and action will be taken as deemed appropriate.  The City Council reserves the right to go into executive session in accordance with Section 84-1410.

 


 

A.   CALL TO ORDER

1.    Pursuant to Section 84-1412(8) of the Nebraska Open Meetings Act a current copy of the Open Meetings Act is posted in the entry of this meeting room and is available for viewing by the public.

2.    Roll Call

 

B.   SUBMITTAL OF REQUESTS FOR FUTURE ITEMS

Individuals who have appropriate items for City Council consideration should complete the Request for Future Agenda Items form located near the entrance of the meeting room.  If the issue can be handled administratively without Council action, notification will be provided.  If the item is scheduled for a committee or Council meeting, notification of the date will be given.

 

C.   CONSENT AGENDA

1.    Approval of the minutes of the regular meeting of January 17, 2012.

2.    Approval of claims.

 

D.   PUBLIC HEARINGS

1.    Public Hearing concerning the City of Fairbury, Nebraska 1 & 6 Year Street

Improvement Plan for 2012–2017.

2.    Public Hearing for the semi-annual review of the Local Option Sales Tax for Economic Development (LB840) Program.

     3.    Public Hearing concerning a “CDBG – Economic Development Loan Fund  (Reuse  Loan)” in the amount of $30,000.00 for the “McBattas Paper Co. dba McBattas  Specialty Advertising” project.

     4.    Public Hearing concerning LB840 funds for a “Performance Based Grant” in the  amount of $20,000.00 for the “McBattas Paper Co. dba McBattas Specialty Advertising”   project.

     5.    Set Public Hearing regarding a request for a Special Use Permit (SU-2012-01) from  Jamalynn Barnett to conduct a home occupation (Bait Shop) in the High Density Residential Zoning District at 207 3rd Street legally described as Lot 8, Block 34, Original Town, City of Fairbury, Jefferson County, Nebraska as allowed under  Article 5, Section 5.08.3d of the City of Fairbury Zoning Regulations – 2005 Edition.

 

E.   CURRENT BUSINESS

1.    Consider application made by Brackle’s Inc. to move a building from 315 C Street, legally described as Lot 1, Block 34, Original Town of Fairbury, Jefferson County, Nebraska to 1025 B Street, legally described as North 38’ of South 43½’ of Lot 3 also known as Tax Lot 1, Block 4, Gibson Addition to City of Fairbury, Jefferson County, Nebraska.

2.    Fairbury Public Library Annual Report for 2010–2011.

3.    Consider selling properties owned by the City of Fairbury: [Parcel 1]  411 A Street: the North 57.28 feet of Lot Sixteen (16), Nutting’s Subdivision of Fairbury, Jefferson County, Nebraska, except the West One Hundred and Twenty (120) feet thereof; [Parcel 2] 

721 G Street: the North 44.5 feet  of Lots 1 & 2, Block 2, Original Town of Fairbury, Jefferson County, Nebraska; [Parcel 3]  917 G Street: the South 47.5 feet of the North One Hundred Ninety (190) feet of the East One Hundred Fifty (150) feet, Block 7,

W.G. McDowell’s Subdivision, an addition to Fairbury, Jefferson County, Nebraska.

4.    Consider recommendation from the Finance & Keno Committee regarding updating the City of Fairbury Code of Ordinances books.

5.    Consider releasing nuisance lien for mowing on property located at 802 3rd Street, legally described as Lot 7, Block 16, McDowell’s 1st Addition of Fairbury, Jefferson County, Nebraska.

 

F.    RESOLUTIONS AND ORDINANCES

1.    Resolution No. 850 approving the 2012 – 2017 One and Six Year Street Improvement Plan.

2.    Resolution No. 851 obligating “CDBG – Economic Development Loan Fund to  “McBattas Paper Co. dba McBattas Specialty Advertising” for a “direct (reuse

            loan)” in the amount of $30,000.00.

3.    Resolution No. 852 obligating LB840 funds to “McBattas Paper Co. dba McBattas Specialty Advertising” for a “Performance Based Grant” in the amount of $20,000.00.

4.    Resolution No. 853 authorizing the City to levy special assessments against certain properties for nuisance abatements.

5.    Resolution No. 854 providing for allowable daily meal expenses paid by the City.

6.    Resolution No. 855 requesting the Jefferson County Court adopt changes to the City of Fairbury Supplemental Fine Schedule in accordance with changes in the City of Fairbury Code of Ordinances and Appendix 6 of the Uniform County Court Rules of Practice and Procedure.
